If Palestinian armed groups operate in civilian areas, Israel still bears all legal and moral responsibility for all resulting deaths.

Summary

Advocacy narratives sometimes argue Israel, as the attacker and/or occupying power, is wholly responsible for civilian deaths in Gaza, irrespective of any Hamas/PIJ operations from civilian areas. Variants appear in campus letters, op‑eds and social posts asserting exclusive Israeli blame for wartime fatalities.

Assessment

IHL assigns obligations to all parties. Defender misconduct—operating from civilian areas or using human shields—is prohibited (AP I 51(7); Rome Statute 8(2)(b)(xxiii)) and engages that party’s responsibility. At the same time, violations by one side never release the attacker from its own duties of distinction, proportionality and precautions (AP I 51(8), 57). Responsibility for civilian deaths is not categorically ‘all’ on Israel nor categorically ‘all’ on Palestinian armed groups; it is incident‑specific and turns on what was known and reasonably anticipated ex ante: the concrete military objective, expected civilian harm (including shields counted as civilians), feasible alternatives/munitions, warnings and evacuations, and after‑action review. Evidence base is mixed: reputable reporting and NGO work document Palestinian fire from populated areas; courts and ICRC commentary confirm defender duties (AP I art. 58). Conversely, investigations have found some Israeli claims about specific sites under‑substantiated, and credible allegations exist of unlawful Israeli strikes and of limited instances where Israeli forces allegedly used Palestinians as shields—matters under inquiry. The categorical claim that Israel bears ‘all legal and moral responsibility’ irrespective of defender conduct collapses core IHL structure and is legally inaccurate.

Why it matters

Assigning sole responsibility influences public accountability, sanctions debates, and legal risk assessments. It can also obscure the reciprocal IHL duties on both attacker and defender (e.g., passive precautions and the ban on using human shields).

enpublic concise

IHL imposes duties on both sides: defender misconduct never licenses unlawful attacks—but it also doesn’t make Israel ‘solely’ responsible for all deaths; responsibility is incident‑specific.

Saying ‘Israel is 100% responsible for all Gaza deaths no matter what’ is not how the laws of war work. Human shields are banned; so are indiscriminate or disproportionate attacks. Duties bind both sides, case‑by‑case.
