Advocacy narratives sometimes argue Israel, as the attacker and/or occupying power, is wholly responsible for civilian deaths in Gaza, irrespective of any Hamas/PIJ operations from civilian areas. Conversely, investigations have found some Israeli claims about specific sites under‑substantiated, and credible allegations exist of unlawful Israeli strikes and of limited instances where Israeli forces allegedly used Palestinians as shields—matters under inquiry. The categorical claim that Israel bears ‘all legal and moral responsibility’ irrespective of defender conduct collapses core IHL structure and is legally inaccurate.
Assigning sole responsibility influences public accountability, sanctions debates, and legal risk assessments. It can also obscure the reciprocal IHL duties on both attacker and defender (e.g., passive precautions and the ban on using human shields).
