Summary

After the ICC Prosecutor announced on May 20, 2024 that he had applied for arrest warrants for Israeli Prime Minister Benjamin Netanyahu and then–Defense Minister Yoav Gallant, some advocacy pieces and social posts stated or implied that the ICC had charged them with genocide. This often stems from confusion between the ICC’s individual criminal charges and the ICJ’s separate state-to-state genocide case (South Africa v. Israel).

The ICC Prosecutor’s public applications on May 20, 2024 did not include genocide charges against Israeli leaders. The Prosecutor’s statement and charge lists identify alleged war crimes (including starvation as a method of warfare and intentionally directing attacks against civilians) and crimes against humanity (including murder/extermination, persecution, and other inhumane acts). When ICC judges later issued warrants (Nov. 21, 2024), they authorized war crimes and crimes against humanity—not genocide. Separately, the ICJ genocide case addresses state obligations and provisional measures; it is not a criminal indictment of individuals. Note: the ICC Prosecutor may amend or expand charges as investigations progress, but as of the May 20, 2024 applications and the November 21, 2024 warrants, genocide was not charged.
