Summary

This claim circulates in some activist, clerical, and militant statements that portray every Israeli settler as a non‑civilian participant in the occupation, often arguing that reserve service, arms carriage, or the illegality of settlements removes civilian protection. It spreads via social posts, fatwas/notices, and media quotes and is used to justify violence against settlers as a category rather than based on individual conduct.

Under international humanitarian law, civilian protection is individual and ex ante. Civilians are protected from direct attack unless and for such time as they directly participate in hostilities; status does not turn on residence, political views, reserve status, or the illegality of settlements. Collective punishment and collective guilt are expressly prohibited. Responsibility for the war crime of transferring an occupier’s civilian population into occupied territory attaches to the occupying power’s decision‑makers, not categorically to every private civilian who resides there. Courts and major humanitarian bodies have repeatedly affirmed that settlers, as a class, remain civilians and are not lawful targets absent direct participation at the time of the act. Therefore, blanket assertions that ‘all settlers are not civilians’ or are collectively responsible or targetable are legally inaccurate and misleading. At the same time, serious settler violence is documented; perpetrators can be individually investigated, sanctioned, prosecuted, and punished—by Israel and by third states—without erasing civilian protections for the broader population.
